The terms of using Calyn.

Calyn is a guidance and self-reflection tool. It is not a medical device, not a healthcare provider, and not a substitute for professional care. Your use of Calyn is at your own discretion and risk.

1. What Calyn is, and is not

Calyn is a software service that uses artificial intelligence to facilitate conversations modeled on evidence-based therapeutic frameworks. It is intended for general wellness and self-reflection only.

Calyn is not:

• A licensed mental health provider or healthcare professional.
• A diagnostic, treatment, or medical device.
• An emergency service or crisis intervention service.
• A substitute for therapy, psychiatry, medication, or any form of professional medical care.

You should not rely on Calyn for medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for any medical or mental health concern. If you are in crisis, contact emergency services or a crisis line immediately, see crisis resources.

2. AI limitations and no guarantee of accuracy

Calyn is powered by artificial intelligence. AI systems can be wrong, incomplete, biased, or unpredictable. Responses generated by Calyn may contain inaccuracies, misinterpretations, or content that is not appropriate for your specific situation.

We make no warranty or guarantee regarding:

• The accuracy, completeness, or reliability of any response Calyn provides.
• Any specific outcome, improvement, or therapeutic result from using the service.
• The suitability of Calyn for any particular individual, condition, or circumstance.

You are solely responsible for evaluating the information Calyn provides and for any decisions you make in reliance on it.

3. Your responsibilities

• You must be at least 18 years old to use Calyn, and you confirm you have the legal capacity to enter into these terms.
• You agree to use Calyn for lawful, personal, non-commercial purposes only. You will not resell, rent, or commercially exploit access to the service.
• You will not use Calyn for any purpose involving medical diagnosis, treatment, or emergency.
• You will not report false emergencies about yourself or any third party, including vulnerable populations.
• You will not use the service in a way that could damage or impair it (introducing malware, denial-of-service, scraping, web-crawling, automated extraction, breaching security protocols, or spamming).
• You will not attempt to reverse-engineer, decompile, or create derivative works of the service.
• You acknowledge that running Calyn on a jail-broken or modified mobile device may impair the service and is a material breach of these terms.
• You are responsible for keeping your sign-in credentials confidential and for all activity that occurs under your account.
• You acknowledge that you are responsible for seeking appropriate professional help when needed.

3a. No obligation to monitor or report

Calyn may, but is not obligated to, review content you submit to the service. We do not represent that Calyn will detect any specific psychological, mental, or physical condition, mood state, risk indicator, or wellbeing issue, nor that we will take any specific action if such issues are present in your conversations. We have no obligation, on behalf of any user or third party, to report potential abuse, self-harm, or other concerns to authorities, and you agree not to bring any claim against us based on our failure to detect or to act on any such content. You remain responsible for seeking emergency help when needed.

4. Disclaimer of warranties

Calyn is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

5. Limitation of liability

To the maximum extent permitted by law, Calyn, its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of (or inability to use) the service, including but not limited to damages for emotional distress, personal injury, or any decision or action you take in reliance on content generated by the service.

Our total cumulative liability for any claim arising from these terms or your use of the service will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the smallest amount permitted by law.

6. Indemnification

You agree to indemnify and hold harmless Calyn and its affiliates from any claim, demand, loss, or damage (including reasonable legal fees) arising from your use of the service, your violation of these terms, or your violation of any third-party right.

7. Subscription and billing

Paid subscriptions auto-renew until cancelled. You can cancel at any time from within the app; cancellation takes effect at the end of the current billing period. Subscription fees are non-refundable, including if you stop using the service before the end of the billing period, except where refunds are required by applicable law or issued at our discretion for service issues we cannot resolve. We may revise pricing on notice; changes take effect at your next renewal.

If you subscribe through the Apple App Store or Google Play, billing, refunds, and cancellation are subject to that platform’s terms. You acknowledge that Apple Inc. and Google LLC are third-party beneficiaries of these terms with respect to your use of the iOS or Android applications, and may enforce them against you. We — not Apple or Google — are solely responsible for the service.

8. Termination

You may stop using Calyn at any time. We may suspend or terminate your access if you violate these terms, abuse the service, or use it for purposes that may harm you or others. We reserve the right to refuse service to anyone.

9. Governing law and disputes

These terms are governed by the laws of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved by binding individual arbitration in Wilmington, Delaware, except where prohibited by your local law. You waive any right to participate in a class action.

10. Changes

We may update these terms. Material changes will be announced at least 30 days in advance by email and in-app notice. Continued use after the effective date means you accept the new terms.
